INTRODUCTION

The following terms and conditions ("Terms and Conditions") are applicable between you and Granny Trading Ltd (Company Number: 13396152) ("Granny Takes a Trip", “Granny”, "us", "we") and govern all usage of and orders placed on Granny Takes a Trip's platform www.granny.london ("Platform").

By using the Platform and/or placing an order on the Platform, you affirm that you have reviewed and accepted the Terms and Conditions. Prior to acceptance, it is essential to read and comprehend our Privacy Policy.

Grading Trading Ltd holds the right to amend the Terms and Conditions at any time. The latest update date is indicated in the final section of the Terms and Conditions. Please be aware that the Terms and Conditions applicable to your order are those you have read and accepted before placing your order, not a subsequent version. It's advisable to retain a copy of these Terms and Conditions for future reference.

Kindly note that Granny Trading Ltd cannot guarantee the availability of all products featured on the Platform. Granny Takes a Trip retains the right to discontinue the sale or rental of a product.

DEFINITIONS:

“Premium Membership”: A paid membership offering exclusive benefits, priced at £120 per year. Further details available here.

“Free Membership”: Complimentary membership essential for renting, subject to the contractual nature of our service. Members must be over 18, based in the United Kingdom, meeting the legal requirements for contract entry.

“Accidental Damage Waiver”: An additional purchase providing peace of mind for accidental damage to rented garments. This will automatically be added to any rental item of clothing and a rental period can not proceed without this Waiver. The fees for the Accidental Damage Waiver can be found in our Fee List and will be outlined in your order confirmation.

The Accidental Damage Waiver ensures that in the event of any accidental damage to the garment(s) prior to the return, you will not be charged for the damage (subject to the conditions below). However, please note that the Accidental Damage Waiver does not cover unreturned garments, loss of items, or intentional damage. It is essential to retain all components, including the reusable packaging and hangers, to avoid additional charges.

Non-return, loss, and theft of rental garments are not covered by the Accidental Damage Waiver. Further information on the penalty for non-return, loss and theft are disclosed later.

“Rental Return Policy”: A 48-hour return window for rented items, ensuring a seamless customer experience.

“Repair Service”: A service to extend the life of Wardrobe products. Exclusive to Premium Members who enjoy free repairs. Free Members can use the service but cover costs unless it's a manufacturing fault. Membership is a prerequisite.

“Buy Back”: Granny's responsible Buy Back scheme for end-of-life products, involving recycling materials and upcycling garments. Further details will be shared in the future.

“Products”: Refers to the range of menswear and womenswear clothing and accessories available for rental or purchase on www.granny.london.

“Members”: Individuals who have registered and been accepted to use the Granny Takes a Trip services. Members can access the platform, search for products, and request to rent or purchase items.

“Intellectual Property Rights”: Encompasses patents, utility models, rights to inventions, copyright and neighbouring and related rights, trademarks and service marks, business names and domain names, rights in get-up and trade dress, goodwill, and the right to sue for passing off or unfair competition, rights in designs, database rights, rights to use, and protect the confidentiality of confidential information (including know-how and trade secrets) and all other intellectual property rights.

“Rent/Renting/Rental”: The process of renting a product(s) via Granny Takes a Trip, involving payment of a rental fee and subject to the terms and conditions.

“Rental Period” - the length of time that Products are with a Member, there is an initial choice between a 7 day or a 30 day period. This can be extended if the Member wishes to either an additional 7 or 30 day period.

“Guests”: Individuals visiting the Granny Takes a Trip platform who are not yet registered as members and can only browse the rental catalogue or purchase wardrobe items.

“User”: An inclusive term referring to both Members and Guests using the Granny Takes a Trip platform.

“Third-Party Content”: References to non-Granny Takes a Trip websites, products, services, or other materials specifically related to third parties appointed to fulfil the provision of the Granny Takes a Trip services or any aspect thereof.

“Sale”: The process of purchasing products from Granny Takes a Trip, either as part of limited pieces from the archive or a range of wardrobe staples referred to as Wardrobe.

“Reusable Packaging”: Refers to Granny Takes a Trip's environmentally friendly packaging options, which include the garment bag, the soft box tote, and the pouch. Please refer to the packaging instructions for more details. These packaging options are utilised for both rental and sales orders.

“Platform” or “Website”: Refers to the online service provided by Granny Takes a Trip, allowing customers to access the rental archive of clothing for rental, as well as offering clothing for purchase. Granny's Platform includes the website at www.granny.london and any other medium, such as a mobile application, made available by Granny Takes a Trip.

“Security Tag” and “Security Seal” Granny Trading Ltd utilises a specialised recyclable security tag to ensure compliance with our return policy. Our security tag is affixed to each product with a tamper-evident seal, featuring a unique serial number. Upon removal, the seal reveals a VOID pattern, signalling that the product has been tampered with and invalidating the return policy. Once the security tag is removed, the product becomes ineligible for return. The Security Tag is applied to all sale items before goods ship from our warehouse. Rental Products have the Security Tag applied at completion of each cleaning process.

PLATFORM USE

When utilising Granny's Platform for renting or purchasing products, you acknowledge that you are entering into a binding agreement with Granny Trading Ltd. This agreement, encompassing both these Terms and any applicable Renters' Terms or Sale Terms, governs your use of the platform and its associated services.

It is crucial to comprehend and comply with these Terms, particularly those specific to renting or purchasing products. You acknowledge full and exclusive responsibility for adhering to the terms of your agreement with Granny Trading Ltd. You agree to indemnify Granny Trading Ltd for any loss or damage to any rented or purchased products, or arising from, and relating to, your use of the platform.

In addition to renting and purchasing products, Granny's Platform allows users to submit User Generated Content (UGC). By using this feature, you agree to abide by any guidelines provided by Granny Takes a Trip for submitting UGC.

Your use of Granny's Platform also extends to any interactive features or services that may be introduced, and you agree to comply with any guidelines or instructions provided by Granny Takes a Trip in this regard.

By engaging with Granny's Platform, you confirm that you have read, understood, and accepted these Terms and any associated policies, including the Privacy Policy and Cookie Policy. If you do not agree with any of these terms, you must discontinue the use of Granny's Platform immediately.

Granny Trading Ltd reserves the right to review and amend these Terms from time to time, with or without notice to you.

Granny Trading Ltd reserves the right to deactivate any account at any time, including without limitation, if it determines that a Member has violated these Terms and Conditions.

Age Restrictions Individuals under the age of 18 are not permitted to use the Granny Platform. Only individuals aged 18 years or older are eligible to become members and make rental transactions on the Granny's Platform. By agreeing to our Terms and Conditions you are confirming that you are aged 18 or above.

Intellectual Property

Granny Trading Ltd's platform, including all its components such as software, text, graphics, images (including any images/photographs taken of your wardrobe), sound recordings, audio-visual works, and other materials provided by or on behalf of Granny Trading Ltd (referred to as the “Granny's Content”), are protected under both United Kingdom and foreign laws. Unauthorised use of Granny's Content may violate copyright, trademark, and other laws. Users have no rights in, or to, Granny's Content, except as permitted under these Terms and Conditions. No other use is permitted without prior written consent from Granny Trading Ltd. Users must retain all copyright and other proprietary notices contained in the original Granny's Content on any copy they make. Users may not sell, transfer, assign, licence, sublicense, modify, reproduce, display, publicly perform, make a derivative version of, distribute, or otherwise use Granny's Content for any public or commercial purpose. The use or posting of Granny's Content on any other website or in a networked computer environment for any purpose is expressly prohibited.

If you violate any part of these Terms and Conditions, your permission to access and/or use Granny's Content and Granny's Website and Granny's Platform will be terminated, and you must immediately destroy any copies you have made of the Granny's Content.

The trademarks, service marks, and logos of Granny Trading Ltd (“Granny Trademarks”) used and displayed on Granny's Platform are registered and unregistered trademarks or service marks of Granny Trading Ltd. Other company, product, and service names located on Granny's Platform may be trademarks or service marks owned by others (the “Third-Party Trademarks”, and, collectively with the Granny Trademarks, the “Trademarks”). Nothing on Granny's Platform should be construed as granting, by implication, estoppel, or otherwise, any licence or right to use the Trademarks, without our prior written permission specific for each such use. Use of the Trademarks as part of a link to or from any site is prohibited unless establishment of such a link is approved in advance by Granny Trading Ltd in writing. All goodwill generated from the use of the Granny Trademarks inures to our benefit.

Elements of Granny's Platform are protected by trademark, unfair competition, and other laws of England and Wales (and elsewhere) and may not be copied or imitated in whole or in part, by any means, including but not limited to the use of framing or mirrors. None of Granny's Content may be retransmitted without our express, written consent for each and every instance.

If you believe that your content has been copied on Granny's Platform in a way that constitutes copyright infringement, please provide us with notice, including (i) a description of the copyrighted work that has been infringed and the specific location on Granny's Platform where such work is located; (ii) a description of the location of the original or an authorised copy of the copyrighted work; (iii) your address, telephone number, and e-mail address; (iv) a statement by you that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law; (v) a statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the copyright owner’s behalf; and (vi) an electronic or physical signature of the owner of the copyright or the person authorised to act on behalf of the owner of the copyright interest.

External Sites

Granny's Platform may contain links to third-party websites (“External Sites”). These links are provided solely as a convenience to you and not as an endorsement by us of the content on such External Sites. The content of such External Sites is developed and provided by others. You should contact the site administrator or webmaster for those External Sites if you have any concerns regarding such links or any content located on such External Sites. We are not responsible for the content of any linked External Sites and do not make any representations regarding the content or accuracy of materials on such External Sites. You should take precautions when downloading files from all websites to protect your computer from viruses and other destructive programs. If you decide to access linked External Sites, you do so at your own risk.

GENERAL

Age Restrictions

Products may only be rented or purchased by individuals aged 18 years or older. By agreeing to these Terms and Conditions, you confirm that you are 18 years of age or older and are authorised to use the chosen payment method for renting or purchasing Products.

Order Limits

We reserve the right to impose limits on the rental or purchase of Products, including restrictions on orders placed under a single customer account, payment card, or billing/shipping address. We may also limit, cancel, or prohibit rentals or sales of Products for any reason at our sole discretion.

Delivery

All deliveries will be facilitated through our shipping partners, which may change over time. We will provide you with information about estimated delivery and arrival times of Products through the Granny Trading Ltd Platform or our shipping partners.

Reusable Packaging

All orders will be shipped in Granny’s reusable packaging, a prepaid return label will be provided with all orders. Packaging remains the property of Granny Trading Ltd.

Making Payments via STRIPE

Customers have the option to make payments for Products via STRIPE. By accepting these Terms and Conditions, you agree to be bound by the STRIPE Services Agreement. You represent and warrant that any details provided to us are accurate and authorise us to share such details with STRIPE. You authorise Granny Trading Ltd to securely store your payment details for rental orders in order for us to recharge your original payment method, should you decide to extend or keep your rental product beyond the original agreed rental period.

Making Payments via PayPal

Users can also choose to make payments via PayPal. For PayPal’s terms of use, please visit the PayPal website.

Non-Payment

Failure to pay amounts owed may result in collection procedures being initiated. You agree to pay our costs of collection, including reasonable legal fees.

RENTAL GUIDELINES

Rental Fee

The rental fee ("Rental Fee") for any rented Product comprises the rental charges listed on the Granny Trading Ltd Platform. By placing a rental order, you authorise us to charge your payment card for the Rental Fee immediately upon order placement. The Rental Fee does not include shipping costs or the Product Indemnity Waiver cost.

Replacement Value Authorisation

Additionally, you authorise us to charge your payment card for an amount equal to 100% of the current market replacement value of the Product, as determined by Granny Trading Ltd ("Replacement Value"). Please ensure adequate funds are available to cover both the Rental Fee and Replacement Value. We reserve the right to charge your payment card for any amount up to the Replacement Value at any time, as per these Terms and Conditions.

Cancellation Policy

While we try to accommodate cancellation requests, our warehouse aims to process all orders within an hour of receipt. Please email customer.service@granny.london with the subject line "CANCEL MY ORDER" Cancellation emails received within one hour of an order being placed will be refunded in full (upon receipt of the Products return, if it has already been dispatched), if a cancellation is requested later than this window then the User should refer to the Rental Return Policy.

Delivery and Shipping

Rented Products will be dispatched to a secure shipping address for next-day delivery, provided the order is received by 12 pm on a business day in the United Kingdom. Delivery dates are specified in the online invoice for your rental order ("Expected Delivery Date"). Upon delivery, you assume responsibility for the Product.

A Secure Shipping Address is strongly recommended for receiving Products. Granny Trading Ltd will not be liable for Products left unattended at unsecured addresses. Delivery to PO Box addresses is not supported. All shipments need to be signed for.

Use of Products

Products are delivered, cleaned and ready to wear. While we clean and inspect each Product meticulously, you assume all risks associated with its use. Granny Trading Ltd is not liable for health-related issues associated with Products.

You agree to handle Products with care and return them in the same condition. You are responsible for any loss or destruction, excluding normal wear and tear. The Accidental Damage Waiver is in place to cover you for the repair cost of any accidental damage to the Product while in your possession. If a Product is returned damaged beyond normal wear and tear or it is clear that damage was not accidental, you agree to pay for repairs or replacement up to the Replacement Value.

Return Process

Your rental period begins on the Actual Delivery Date (according to the ‘Proof of Delivery’ provided by Granny’s Shipping Partner.) and ends on either 7 or 30 days. It's your responsibility to ensure timely return of Products by the Return Date.

The delivery Packaging should be reused. With each order we provide a Packaging Seal and a pre-paid, pre-addressed return label. Please use this for return shipping. Lost or damaged Reusable Packaging may incur fees.

Late Fees

If a/the Product(s) is/are not returned by the end of the rental period (7 or 30 days), the rental will automatically renew for 7 days rental on the Product(s) according to the pricing on Granny’s Platform at the given time. You will continue to be charged every 7 days for the following 6 weeks.

If a Product(s) is not returned by the end of a 6 week period then the full RRP will be charged on the missing Product(s), in addition to any late fees already paid.

Lost Return Packaging

Lost Return Packaging will require you to return the Product at your expense. Failure to return the Granny’s Reusable Packaging may result in a £20 fee.

Limited Warranties

Products are warranted to be cleaned and ready to wear. Sizing Returns are permitted within 48 hours of receipt, according to the Rental Return Policy.

SALES

The following additional conditions apply to the sale of any Product.

Sales of Products - Warranty

You acknowledge and agree that only those Products designated by us on the Granny website as available for purchase are eligible for purchase by you – some Products are available for rental only.

Granny’s ‘New’ Products, (Products manufactured by Granny and offered for Sale) are covered by our warranty for genuine manufacturing faults. Please contact our Customer Service team to notify us of a suspected faulty Product. Faulty requests can only be accepted within 6 months of purchase. Items that are damaged as a result of normal wear and tear are not considered to be faulty.

Granny will clean and inspect purchased ex-Rental or Vintage Products before they are delivered to you. However, all ex-Rental and Vintage Products are sold on an “as is” basis, without any warranty whatsoever, and all Product sales are final, save as set out under “Returns” below.

Purchase Price

The purchase price (“Purchase Price”) for the Products will be the purchase fee and delivery charges listed on the Granny website in connection with your purchase of the Products. The Purchase Price is as listed on the Granny website at the time of purchase. Granny reserves the right to discount, alter the Purchase Price, or the availability of any particular Product at its discretion and without notice. Upon your purchase order for a Product, you hereby authorise Granny (or our payment services provider) to charge your payment card for the Purchase Price. We (or our payment services provider) will charge your payment card the amount of the Purchase Price immediately upon your purchase order.

Returns

If you have made a purchase order and decide to return the Product you have purchased, you must notify Granny of such decision. You have 14 days to communicate this and return the relevant Product. You must then return the relevant Product to Granny using the provided pre-paid return label. On receipt of the relevant Product, Granny will then issue you a full refund of the Purchase Price (less a £5 return shipping fee for each item) of the Product, so long as the Product, in our sole discretion, has not been worn and has the Product Security Tag and Security Seal attached.

Returns will not be accepted, and refunds will not be issued, if Granny determines, in its sole discretion, that the relevant Product has been worn, is damaged, or otherwise in a worse condition than it was in when dispatched by Granny

All returns to Granny should be dispatched using the return label provided by Granny. If the Reusable Packaging is not correctly sealed with the Packaging Seal and Product(s) are not received by Granny, the customer will be liable for the full replacement value of the Product.

Packaging

Reusable Packaging used for retail orders should be shipped back using the prepaid return label no later than 14 days of your order being delivered.

Liability for Loss and Damage:

Granny Trading Ltd is committed to ensuring that any foreseeable loss or damage caused by us is addressed responsibly. We accept responsibility for loss or damage you may suffer that is a foreseeable result of our failure to uphold these terms, or our lack of reasonable care and skill. However, we cannot be held responsible for any loss or damage that is not foreseeable. Loss or damage is considered foreseeable if it is obvious that it may occur, or if both parties were aware of the possibility at the time the contract was formed, such as through discussions during the sales process.

Exceptions to Liability:

We do not seek to exclude or limit our liability to you where it would be unlawful to do so. This includes liability for death or personal injury resulting from our negligence or that of our employees, agents, or subcontractors; for fraudulent activities or misrepresentation; and for breaching your legal rights concerning the products. These rights include receiving products that are accurately described, of satisfactory quality, fit for their disclosed purpose, and supplied with reasonable skill and care. We also accept liability for defective products under the Consumer Protection Act 1987.

Business Losses Exclusion:

Granny Trading Ltd's products are intended for domestic and private use only. Therefore, we cannot be held liable for any business-related losses. If you choose to use our products for commercial, business, or resale purposes, we bear no responsibility for any resulting loss of profit, business interruption, or missed business opportunities. Our liability extends solely to the intended domestic and private use of our products.

Termination of Granny Trading Ltd's Terms and Conditions

Granny Trading Ltd reserves the right, at our sole discretion, to limit, suspend, or end these Terms and Conditions and your access to any or all aspects of our Platform, at any time and for any reason, without prior notice or liability. However, even after the termination of these Terms and Conditions, certain provisions will continue to be enforceable:

Intellectual Property: Our rights concerning intellectual property on the Granny Trading Ltd Platform.

Terms and Conditions for Customers: Specific terms regarding rentals, including rental fees, cancellation policies, late fees, and limited warranties.

No Warranties/Limitation of Liability: Our disclaimer of warranties and limitations on liability.

Termination of these Terms and Conditions: The process and consequences of terminating these Terms and Conditions.

Miscellaneous: Other relevant provisions that continue to apply.

Granny Trading Ltd also retains the right to modify, suspend, or discontinue any part of our platform, including the website and associated services, at any time and without prior notice or liability.

COMMUNICATIONS

Communications to Granny Trading Ltd

While we welcome your correspondence via email, we advise against sending any confidential information through this channel. Any emails or communications you send to us, including feedback, enquiries, suggestions, and the like, may be utilised by Granny Trading Ltd for various purposes, including product and service development, without any obligation to maintain confidentiality.

Communications from Granny Trading Ltd

By using our services, you consent to receive communications from Granny Trading Ltd, which may include emails, text messages, calls, and push notifications. These communications may include updates on your orders, reminders, secondary authentication, and other relevant information. We may contact you via telephone calls or text messages, including through an automatic telephone dialling system, using the contact information provided by you. Please note that standard message and data rates may apply to text messages. You have the option to opt out of receiving communications by following the unsubscribe instructions provided, or by replying "STOP" to any text message received from us. Kindly be aware that opting out may affect your access to certain features of the Granny Trading Ltd platform.

MISCELLANEOUS

These Terms and Conditions are governed by the laws of England and Wales.

Granny Trading Ltd's failure to enforce any provision of these Terms and Conditions shall not constitute a waiver of such provision or any other provision herein. Any waiver must be made in writing to be effective. These Terms and Conditions constitute the entire agreement between you and Granny Trading Ltd, superseding any previous agreements, whether written or oral, concerning the subject matter herein. Section headings are for convenience only and do not carry legal significance. These Terms and Conditions shall be binding upon and inure to the benefit of the parties and their successors, assigns, licensees, and sublicensees.
